Terms and Conditions for Artist Portfolio Website

 

Please read these terms and conditions carefully before using the artist portfolio website operated by Michal Halasa ("the Artist").

 

By accessing or using the website, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms and conditions, you must not use the website.

 

Definitions

  • "Website" refers to the online platform operated by the Artist for showcasing and selling artworks.

  • "Customer" refers to any individual or entity purchasing artworks from the Artist's website.

 

Artworks

  • The artworks displayed on the website are the original creations of the Artist.

  • All artworks are subject to availability and may be subject to change without notice.

 

Ordering Process

  • Customers may place orders for artwork by emailing info@mikehalasa.art.

  • By placing an order, the Customer agrees to purchase the selected artwork at the specified price and agrees to the handling, shipping and refund policy.

 

Pricing and Payment

  • Prices for artwork are displayed on the website and are subject to change without notice.

  • Payment must be made in full at the time of placing the order.

  • For greater protection, The Artist accepts payments through PayPal only.

 

Handling & Fulfilment

  • During busy periods or if there are unexpected issues with the print provider, the preparation and fulfilment of orders may take up to 14 working days from the date of purchase as every single print is individually ordered, inspected, signed and stamped to certify the authenticity.  

  • The estimated delivery date will be provided upon the confirmation of the order. 

  • The Artist will make reasonable efforts to ensure timely processing and shipment of orders.

  • In the event of any delays in handling or fulfilment, the Customer will be notified promptly via the contact information provided at the time of the order.

  • The Artist is not liable for any delays in handling or fulfilment that are beyond reasonable control, including but not limited to natural disasters, transportation disruptions, or governmental actions.

 

Shipping and Delivery

  • The Artist will endeavour to ship the purchased artwork to the Customer as soon as the fulfilment process is completed. 

  • Shipping costs will be calculated and displayed at the time of checkout for all orders.

  • International customers are responsible for any extra duty/customs fees. 

  • The Customer is responsible for providing accurate shipping information.

  • The Artist is not liable for any delays or issues arising from inaccurate shipping information provided by the Customer.

  • All shipping methods are tracked and require a signature upon delivery. 

  • All A4 & A3 prints will be shipped using Royal Mail. Paintings and large orders including A2 & A1 prints will be shipped using Parcelforce when possible. 

 

Returns and Refunds

  • The Artist does not accept returns or offer refunds for artworks unless they are damaged during transit/upon arrival.

  • If an artwork is damaged during shipping, the Customer must contact the Artist within 7 days of receiving the artwork to arrange for a replacement or refund minus the shipping & handling costs.

  • In the case of paintings that are 1/1 pieces, the replacement can be arranged for another artwork of the same value. 

 

Copyright and Intellectual Property

  • The copyright and intellectual property rights for all artworks remain with the Artist.

  • Customers may not reproduce, distribute, or use the artworks for commercial purposes without the prior written consent of the Artist.

  • Customers acknowledge that the artworks are the intellectual property of the Artist and may not be reproduced, distributed, or used for any commercial or non-commercial purposes without the explicit written consent of the Artist.

  • Copying or downloading of the artwork for any use is strictly prohibited.

  • Customers may only use the purchased artworks for personal display and enjoyment and may not resell, sublicense, or otherwise transfer the artworks to any third party without the prior written consent of the Artist.

 

Limitation of Liability

  • The Artist shall not be liable for any indirect, incidental, special, or consequential damages arising out of the purchase or use of artworks.

  • In no event shall the total liability of the Artist exceed the total amount paid by the Customer for the purchased artwork.

 

Governing Law

  • These terms and conditions shall be governed by and construed following the laws of England.

  • Any disputes arising out of or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.

 

Changes to Terms and Conditions

  • The Artist reserves the right to update or modify these terms and conditions at any time without prior notice.

  • Continued use of the website after any such changes shall constitute your consent to such changes.

 

By using the Artist's website and purchasing artworks, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
